
I have been reading, and chatting along with so many others. I came across this comment and it's a fantastic write up about the premeditation of the murder of little Caylee Anthony. I was given permission to quote this. I was given permission to copy and paste this. I did however delete the first few words. Those words were addressing another Newsviner name. She didn't accidentally whip up a batch of chloroform. She had ample time to not research it, not create it, to pour it down the sink rather than use it, or after administering it to rush her child to the hospital for treatment. She didn't do that. This was intentionally created and intentionally administered.
She didn't accidentally place her child in the hot trunk of a car. This is Florida, late afternoon temp was 82 degrees, which is magnified in the confines of a car trunk. She could have stopped, she didn't have to put the kid in the trunk, there was ample time to turn around and not do what she did. She didn't stop. She didn't seek help. This was intentional.
She didn't discover a roll of duct tape laying about unused and accidentally rip up and tear off a long strip of duct tape and apply it to her child's face/head. She had ample time to not tear off the duct tape, to think twice about not applying it to her innocent child, she had ample time to rip that strip off the child's face. She didn't do that. She didn't stop. She didn't seek help. This was intentional.
She didn't accidentally rip up and tear off a second strip of duct tape and apply it to her child's face/head. She had ample time to not tear off that second piece of duct tape, to not apply that second piece of duct tape to her child's face/head, she had ample time to rip that second strip off along with the first. She didn't do that. She didn't stop. She didn't seek help. This was intentional.
She didn't accidentally rip up and tear off a third strip of duct tape and apply it to her child's face/head. She had ample time to not tear off that third piece of duct tape, to not apply that third piece of duct tape to her child's face/head, she had ample time to rip that third strip off along with the first and second. She didn't accidentally discover a roll of plastic garbage bags and accidentally rip off a bag and place her child's body inside it and tie it off. At this point we do not know the child had died of chloroform OR asphyxiated due to duct tape, there is a chance she was still breathing minutely, so placement in a garbage bag and sealing it closed may have caused suffocation. She could have stopped. She didn't have to pull the bag off the roll or stick her child into it. She didn't do that. She didn't stop. She didn't seek help. This was intentional.
She didn't accidentally pull off a second plastic garbage bag from the roll to place her child's body into another plastic bag and seal it closed as well. She didn't do that. She didn't stop. She didn't seek help. This was intentional.
THAT my friend, is PREMEDITATION in a nutshell. Deliberate malice aforethought.
But it also illustrates that the intent to harm can be formed in seconds, and the court holds that to be true.
She may have accidentally killed the child by giving chloroform and sticking her in a hot trunk. It does not take away from the fact that the child died as the result of deliberate felonious acts of aggravated child abuse and under the Florida statute, when someone dies as the result of a commission of a felony it is Felony Murder and a capital offense. Death Penalty worthy, not that I think she'll get death, but the jury might surprise me.
